It is the responsibility of the Client to review Best Trade Bid Pty Ltd's Web site periodically to ascertain whether these Terms and Conditions have changed. The amended Terms and Conditions will become effective as soon as they are posted on Best Trade Bid Pty Ltd's Web site, following which, if the Client continues to use the service, the Client is deemed to have agreed to be bound by those amendments.
  • 1.2. You warrant to Best Trade Bid Pty Ltd, that you will only use this Web Site for lawful purposes. You further warrant and undertake to us that, you will not, nor will you authorize or permit any other person to, use our servers and equipment in violation of any law or regulation, recklessly post or link to or transmit any material that is unlawful or otherwise objectionable in any way, give rise to civil liability or that violates or infringes any trade mark, copyright, other intellectual property rights or similar rights of any person under the laws of any jurisdiction.

Since this service is free to inquirers, Best Trade Bid Pty Ltd, does not guarantee that a service provider in any category will respond to any request by Best Trade Bid Pty Ltd to contact any client. While every reasonable effort will be made to encourage service providers to respond, it is entirely up to providers to respond or not. Once Best Trade Bid Pty Ltd has supplied the client information to providers, Best Trade Bid Pty Ltd has fulfilled its responsibility to both the client and the provider. If there has been no response within 24hours a second attempt will be made to find a provider. Best Trade Bid Pty Ltd considers this action to be of reasonable effort.
  • 1.7. The money back guarantee is conditional on proof of a mismatch. If the business details have been correctly submitted to the business profile (either by the registered Best Trade Bid Pty Ltd client, or Best Trade Bid Pty Ltd staff) and for any reason the system has mismatched their business to a buyer which has submitted a job, at the discretion of Best Trade Bid Pty Ltd management, the lead credit that was deducted, will be replaced to that business's lead stocks.

  • 2.1. The professionals listed on the Best Trade Bid Pty Ltd website, and databases are individual companies. They do not represent Best Trade Bid Pty Ltd, are not employed by Best Trade Bid Pty Ltd, and therefore Best Trade Bid Pty Ltd is not liable for any services or products provided by the professionals listed in the Best Trade Bid Pty Ltd database or website.

3 Disclaimer of Consequential Damages

  • 3.1 To the fullest extent permitted by applicable law, in no event shall the company, Best Trade Bid Pty Ltd, its suppliers, or any third parties mentioned on the web site be liable for any indirect, incidental, consequential, exemplary, special or punitive damages (including without limitation any damages resulting from lost profits, lost data or business interruption) arising from or relating to the use or inability to use the web site and the material, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.

After a service provider contacts you, it is up to you to provide further information should it be required.
Intellectual Property
  • 4.1 All intellectual property rights in information, data and materials used or appearing on the Best Trade Bid Pty Ltd site including (without limitation) all software, tools, know-how, equipment or processes, trademarks, logos and other materials shall remain the sole and exclusive property of Best Trade Bid Pty Ltd or its licensors. User acknowledges and agrees that it shall not acquire any rights, title or interest in or to any of Best Trade Bid Pty Ltd intellectual property rights. To the extent that User submits any information or material to Best Trade Bid Pty Ltd relating to a Job Request or for otherwise posting information on the Site, User automatically grants Best Trade Bid Pty Ltd a license to use the information or material for the purpose for which it is provided.

Service providers:

Payments

  • 5.1 Payments to Best Trade Bid Pty Ltd may be made by credit card, or direct deposit (EFT). If Provider pays by credit card, Provider agrees that Best Trade Bid Pty Ltd may automatically charge any fees associated with that facility to such cards.
  • 5.2 Provider acknowledges and agrees that payments due under this Agreement shall not be deemed to have been received until all amounts payable are received in clear funds in Best Trade Bid Pty Ltd's bank account.

Records

  • 6.1 Provider agrees that Best Trade Bid Pty Ltd's records (including records of SMS messages, faxes, and emails sent or any electronic media by it, or on its behalf) shall be conclusive evidence of Best Trade Bid Pty Ltd's transmission, and Provider's receipt of notifications of Job Leads, and Job Lead Credit Notifications, or any correspondence.
  • 6.2 Provider will be issued a user identification number and password by Best Trade Bid Pty Ltd to use for access to the Site. Provider agrees that Best Trade Bid Pty Ltd shall be entitled to assume that any person using the site with Provider's user identification number and/or password is Provider or its authorized representative.
  • 6.3 Provider acknowledges and agrees that Best Trade Bid Pty Ltd is not a party to any agreement or arrangement between Provider and any User regarding any Job. Best Trade Bid Pty Ltd is a neutral facilitator only.
  • 6.4 Best Trade Bid Pty Ltd provides User contact details and job descriptions as Job Leads to Providers on an 'as is' basis without any warranties of any kind, express, implied or statutory as to their accuracy or otherwise. A Provider must satisfy itself through its own enquiries as to the ability of the User to pay for goods and services it provides.

Business Registration

  • 7.1. Best Trade Bid Pty Ltd offers two types of Registration, Express Lead referrals, and Standard Lead referrals.
  • 7.2. Express Lead Referrals: If a provider chooses this option, each request from a potential client that falls within the category according to the product list, and the area the service is to be provided in, and according to information on Best Trade Bid Pty Ltd database as entered by its Providers in the registration form completed and submitted, at the time of registration, and according to the number of providers requested by the client, express lead holders will receive the reference as soon as a submission is made to search for a product or service, by their preferred form of contact as they have requested, and as determined by Best Trade Bid Pty Ltd's, and its associated third party's search engines. At this point, the business receiving the lead will be deducted the appropriate number of lead credits from their lead pack stock.
  • 7.3. If the number of providers to be contacted is limited at the client's request, then to the best of Best Trade Bid Pty Ltd's ability, businesses will be sent leads on a rotational basis, however Best Trade Bid Pty Ltd will not be held responsible for failure in the distribution of client leads, or enter into debate over what others may consider fair distribution.
  • 7.4. Standard Lead Referrals: If a provider chooses this option, the client's request can be viewed on the Best Trade Bid Pty Ltd web site, and client's details can only be obtained from a list of jobs available at via the appropriate links. When a client's information is requested by a Provider, the Provider will be deducted the appropriate number of lead credits and information will be forwarded via the preferred form of contact, together with the number of lead credits left.
  • 7.5. Best Trade Bid Pty Ltd lead credits have no expiry date, and are nonrefundable. Generally a minimum of seven days notice will be given of an intended price rise via the web site, but may be altered in price without notice. From time to time Best Trade Bid Pty Ltd will distribute free lead credits in special promotions, and reward programs, at its own discretion.
  • 7.6. Best Trade Bid Pty Ltd will use a variety of modern technological systems to obtain accurate information regarding the suitability of a Provider to match them to a lead, our system is designed to eliminate the chance that not enough information is provided, however despite our best efforts, due to occasional limited information, or misinformation submitted by a client on the web site, over which we have no control, there may be some mismatch of leads to Providers. This is a risk associated with the option of Express Leads. Best Trade Bid Pty Ltd will not be held responsible for the loss of a lead credit in such a case. Best Trade Bid Pty Ltd likens this to a client walking into your shop, and walking out again realizing that the product or service they require is not provided by you. You still have the opportunity to promote your business to that client on a one to one basis, no matter what the requested product may be. If a Provider suspects a hoax lead, it must be reported to Best Trade Bid Pty Ltd in writing with a description of the alleged offence as soon as possible, so legal action can be taken.

Termination of Services

  • 8.1 The Provider can at any time terminate their registration by providing Best Trade Bid Pty Ltd with notice in writing, or via the web site page "My Account". All leads credits held are nonrefundable Best Trade Bid Pty Ltd can, without the need to give any reason, terminate all services by providing the customer 14 days notice in writing. Any lead credits held in stock are non-refundable. Best Trade Bid Pty Ltd reserves the right to remove any business from the registered list of providers if it deems a business to be acting outside the law, or in breach of the agreement set out in the terms and conditions of use. Such a business will be asked to show cause for their suspected or proven actions, and will be given opportunity to settle any dispute, however Best Trade Bid Pty Ltd reserves the right to all legal recourses available to it, to pursue compensation for any loss to Best Trade Bid Pty Ltd (including its reputation) caused by inappropriate action or in breach of this agreement by a Provider, or any person using the system.
